On or about October 31, 2014, while employed as a Registered Nurse in a medical facility in Houston, the RN violated the privacy and confidentiality of a patient in that she accessed medical records without authorization and shared confidential medical information with the patient’s employer. 

Her conduct exposed the patient unnecessarily to a risk of harm from disclosure of her confidential medical information without her written authorization and constitutes a violation of the Health Insurance Portability and Accountability Act (HIPAA) 

The Texas Board of Nursing is the one that has full jurisdiction on cases involving RNs and LVNs. Therefore, the LVN was summoned by the Texas Board of Nursing to explain her side.

During the hearing, the RN states, as part of any follow-up, she always checked for a signed consent before meeting the individuals or making phone calls. She states the step of checking for a signed consent is part of following the hospital established guidelines for HIPAA (The Health Insurance Portability and Accountability Act) rules, as well as state and federal regulations. 

The RN further states during her tenure, as part of the leadership team, she did not get involved in a patient case without a request for assistance so she is “perplexed” as to how she could have called the patient’s employer to release information without her consent and the information is not even related to her treatment. 

Because of this, the Texas Board of Nursing suspended and disciplined the RN.
