It’s best to seek the help of a nurse attorney when facing charges related to alcohol use. However, some nurses tend to face these results instead without thinking that nurse attorneys are always reliable for matters such as these.

This is what happened to a certain LVN in San Antonio, Texas in January 2014. During the time of the initial incident, the LVN was employed in a medical facility in Lufkin and had been in the position for more than two years.

On or about January 24, 2014, the LVN lacked fitness to practice professional nursing in that she admitted herself for treatment of alcohol dependency. Furthermore, after returning to work, the LVN experienced a relapse and returned to the rehab center.

The LVN’s condition could have affected her ability to recognize subtle signs, symptoms or changes in patients’ conditions, and could have affected her ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patients in potential danger.

The Texas Board of Nursing gave the LVN the chance to defend herself. During the hearing, the RN states she did not lack fitness to practice because she never drank prior to work or while at work. The LVN states she first sought treatment in December 2012, and after a relapse, she returned to treatment in January 2014. The LVN states her employer suggested she enroll in TPAPN. She admits she had a brief relapse and a positive drug screen in December 2014.

However, she was not able to provide a good defense for herself, especially when the drug screening results were brought up to her. Therefore, the Board placed her license to a disciplinary action instead.
