Accusations are stressful issues for an RN or LVN, except when a nurse attorney assists you against the case. The Texas Board of Nurses is responsible for all hearings against RNs and LVNs undergoing a case that may revoke suspend or only discipline their license. On or about June 26, 2015, while employed as a Licensed Vocational Nurse in a medical facility in San Antonio, Texas, the LVN neglected to follow a patient’s Plan of Care, in that she allowed the patient to remove her Heat Moisture Exchanger (HME).

Additionally, the LVN allowed the patient to play in a creek. Her conduct was likely to injure the patient in that failure to follow treatments as ordered by a physician could have resulted in non-efficacious treatment.

The LVN was summoned before the Board to defend against the case. In response to the accusations against her, the LVN states patient frequently removed her HME and she replaced it many times throughout her shift. She states the HME must remain on at all times. The LVN states she was always at the patient’s side when she would take her to the creek. She states the HME was on as well as reinforced dressing to the G tube site with tape over it. The LVN states patient splashed her feet and legs and was bathed well upon return home. The LVN states she felt this was providing cognitive stimulation and would never place any patient’s life at risk.

But without the proper help from a good defense attorney, the LVN lost the case and she was disciplined and suspended.

The Texas Board of Nursing then subjected the LVN and her license into disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the LVN hired one.
