Additionally, the RN inaccurately documented completing a home health visit in the patient’s   Medical Record.    The RN’s conduct created an inaccurate medical record and was likely to injure the patient in that leaving the nursing assignment could have resulted in the patient not receiving the care that he needed.

The Texas Board of Nursing is the one who has full jurisdiction on cases involving RNs and LVNs. Therefore, the RN was summoned by the Texas Board of Nursing to explain her side. She states she did take the patient to her home to pick up her son, and once arriving home she became sick.  The RN further states one of the patient’s respite providers, that also works in her home, offered to take him until she returned.

However, the RN failed to hire a nurse attorney to help her with her case. Because of this, the Texas Board of Nursing suspended and disciplined the RN. The Board stated that the RN should not do things which could exceed the limitations of nurse-patient relationship as well as false documentation of patient’s records.
