The Texas Board of Nursing (BON) has the jurisdiction to hear and decide cases involving the practice of professional nursing in Texas. Any RN or LVN found guilty for violating the state laws and regulations may be subjected to a disciplinary case if not properly defended by a nurse attorney. 

On or about  November  22, 2016  through  December 13,  2016,  while  employed  as  a in an emergency hospital in Lakeway, the LVN misappropriated three injections of Hydromorphone  l mg/ml, three vials of Morphine 4mg/ml, one vial of Lorazepam 2 mg/l ml, and three vials Fentanyl 1OO mcg belonging to the facility and patients, and failed to take precautions to prevent such misappropriation. Her conduct was likely to defraud the facility and patients thereof of the cost of the medications.

In response to the complaints filed against her,  she states the department was inefficiently and inappropriately staffed with inexperienced nurses, including those  who  did  not  have  access  to  the  medication  dispensing  system.  She claims the medications were removed in error by her due to an error in the dispensing system, which did not have safe guards to help ensure the right medications were removed for the right person.

The LVN further states she was frequently relied on to remove medications for the majority of the patients treated in the department.  Often medications could have been removed under her name by someone other than her while her account was still logged in.  She states she attempted to document to the best of her ability, but claims without an approved procedure, this documentation can be rejected or mishandled.

However, due to her failure to hire an experienced nurse attorney, her license was disciplined by the Texas Board of Nursing.
