The Texas Board of Nursing (BON) is the government agency that has jurisdiction to hear and decide administrative cases involving RN and LVN in Texas. It is also the agency that is responsible for overseeing the practice of professional nursing all over the state of Texas.   • told a wife of a patient that the patient was kissing and flirting with another woman in the facility;
  • told a wife of a patient that a patient was “messing with the other women in the facility”: yelled at a patient stating she was not a baby;
  • told a patient “don’t you ever threaten my job again”;
  • when a patient asked the LVN for a snack the LVN yelled at the patient stating it wasn’t snack time yet;

The LVN’s conduct was likely to injure the patients in that it exposed the patient unnecessarily to a risk of experiencing delayed distress which may not be recognized or felt by the patient until harmful consequences occur.

During the hearing, the LVN states she would never threaten a Resident in such a manner, and is a firm believer in Resident Rights and their right to refuse or ask for medications. The LVN  states that she did not pass “PO” medication as there was a Certified Medication Aide on duty who passed all the “PO” medications. The LVN  states the Residents are adults and she respects that and would not involve herself in, or try to create, problematic or “drama” type situations for any Resident or herself.

The LVN states she does not yell, and would never intentionally yell at Residents, but does have a loud speaking voice and regrets that some of her actions have been misconstrued or misunderstood and will continue to make improvements.
