The Texas Board of Nursing (BON) has the jurisdiction to hear and decide cases involving the practice of professional nursing in Texas. Any RN or LVN found guilty for violating the state laws and regulations may be subjected to a disciplinary case if not properly defended by a nurse attorney. 


On or about August 4, 2018, through August 14, 2018, an LVN from Fort Worth failed to completely document nursing assessments and narrative notes regarding resident hospital in the medical records of three patients. Her conduct resulted in incomplete medical records and exposed the residents to a risk of harm in that subsequent caregivers would not have accurate and complete information on which to base their care decisions.

In response to the incidents, the LVN states that the facility was short of staff and supplies much of the time. She states that the patient had a change in condition, and she immediately went and assessed him. At that time, she called his doctor and got an order to send him to the hospital. She states that for the other patient, she did three dressing changes on the resident, as ordered, and there was no change in the condition noted at any time. The LVN further states that the resident was sent to the hospital hours after she left her shift. The LVN states that she last checked on another patient around 4 pm, and he was fine at that time; he was sent to the hospital the next day.

However, the LVN was not able to provide a good defense nurse attorney to help her defend her side. As a result of the conviction, the LVN was sentenced to probation and ordered to pay an amount. She was disciplined warning to a suspension of her LVN license by violating the Texas Board of Nursing regulation.
