If you have been summoned and have received a letter from the Texas Board of Nursing regarding a case or complaint filed against you, seeking and hiring a nurse attorney is the solution for that.  This should be the first thing to do for an RN or an LVN before facing the case they are in.

At the time of the initial incident, an LVN was employed as a Licensed Vocational Nurse at a Hospital in Garland, Texas, and had been in that position for two (2) years and eleven (11) months.

An incident happened on or about April 28, 2020, the LVN failed to administer Carbamazepine, Diphenhydramine, and Ziprasidone as ordered to three patients. The LVN’s conduct was likely to injure the patient in that failure to administer medications as ordered by the physician could have resulted in non-efficacious treatment.

And n or about April 28, 2020, the LVN falsely documented that he administered medications to the three patients when the LVN never signed into the building with the patients and he was never seen on surveillance video entering the building. The LVN’s conduct was deceitful and resulted in an inaccurate medical record.

In response to the incident, the LVN admits they are true. He explains since the incident he has worked and believes he’s put forth more effort into his patient care because he knows that falsely documenting was a serious act that not only damaged his reputation but the nursing profession. The LVN claims he knows what he did was wrong and he cannot make that mistake again.

As a result, the LVN will be put into disciplinary action. The LVN’s actions were a violation of the nursing practice cause pursuant to Section 301.452(b) (10) & (13) of the Texas Occupations Code.
