The LVN was unprepared to enact the necessary nursing interventions of notifying the physician, the Director of Nurses, and/or Medical Director of the patient’s change in condition, and calling Emergency Medical Service (EMS) transport the patient to an emergency room to obtain appropriate medical interventions on behalf of the patient. Her conduct deprived the patient of an appropriate level of nursing care.

The Texas Board of Nursing is the one who has full jurisdiction on cases involving RNs and LVNs. Therefore, the LVN was summoned by the Texas Board of Nursing to explain her side. In response to the incident, the LVN states this was her first nursing job and due to her lack of experience and training there were things she did not know, and she trusted the report she had received from the more experienced off-going nurse. She states she had three (3) days of orientation and was not informed that the facility had a Medical Director that could be contacted in an emergent situation.

However, the LVN failed to hire a nurse attorney to help her with her case. Because of this, the Texas Board of Nursing suspended and disciplined the LVN.
