A controlled substance is a drug that is tightly controlled or regulated by the Controlled Substance Act because for the reason that it can be abused or even caused addiction. If such a drug is administered incorrectly without a valid order from a physician or unlawful possession of such substance can bring great harm to a patient. The RN will be held accountable for it. At the time of the incidents, the RN was employed as a Registered Nurse at a hospital in Abilene, Texas, and had been in that position for eight (8) months.

An incident happened on or about August 8, 2019, the RN engaged in the intemperate and/or unlawful use of cocaine and morphine in that she produced a specimen for a reasonable suspicion drug screen that resulted positive for cocaine and morphine. Unlawful possession of cocaine and morphine is prohibited by Chapter 481 (Controlled Substances Act) of the Texas Health & Safety Code. The use of cocaine and morphine by a Nurse, while subject to call or duty, could unpaired the nurse’s ability to recognize subtle signs, symptoms, or changes in a patient’s condition, and could impair the nurse’s ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing a patient in potential danger.

The above action constitutes grounds for disciplinary action against the RN in accordance with Section 301.452(b)(9)&(10), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.12(4),(5),10)(A), (1 0)(D) &(1 1B).

The RN could have received a different ending result if he had consulted and ask assistance from a nurse attorney. But he failed to hire a nurse attorney that has led to the decision of the Texas Board of Nursing.
