Every practicing RN license holder in the state of Texas is required to follow certain rules and regulations imposed by the government. These laws and statutes were implemented to ensure that the safety of the patients is protected by the state. An RN / LVN who commits any violation can place his / her license in jeopardy. The Texas Board of Nursing has the authority to revoke or suspend an RN license in the country for as long as there is a justifiable reason. On or about March 1, 2019, through May 8, 2019, while employed as an LVN with a healthcare agency in Lewisville, Texas, LVN falsely documented thirty-five (35) visits for fifteen (15) patients that did not occur. LVN’s conduct created an inaccurate medical record and was likely to deceive other caregivers who needed complete information on which to base their care.

The above actions constitute grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and are a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B)&(1)(D) and 22 TEX. ADMIN. CODE §217.12(1)(B),(1)(C),(6)(A)&(6)(H).

On or about September 25, 2019, while employed as an LVN with a healthcare facility in Lewisville, Texas, and assigned to provide nursing services for a patient, LVN did the following:

1. failed to perform a catheter change causing the patient to go weeks without a new catheter. When the catheter was changed, the catheter tip was covered in mucous/sediment. LVN was likely to injure the patient and unnecessarily exposed them to the risk of harm from possible infections.

2. falsified nursing notes for a visit she did not complete. LVN’s conduct created an inaccurate medical record and was likely to deceive other caregivers who needed complete information on which to base their care.

The above actions constitute grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B),(1)(C),(1)(D)&(1)(M) and 22 TEX. ADMIN. CODE §217.12(1)(B),(1)(C),(6)(A)&(6)(H).

However, without hiring an experienced nurse attorney to defend her case, the Texas BON found the LVN guilty, and her license to practice nursing in the State of Texas was revoked.
