It’s best to seek the help of a nurse attorney when facing different complaints and allegations. However, some nurses tend to face these results instead without thinking that nurse attorneys are always reliable for matters such as these.
In San Antonio, federal court alleged that a certain LVN defrauded the federal workers’ comp program out of millions of dollars through her physical therapy clinics.
According to authorities, the federal worker’s compensation program administered by the U.S. Department of Labor does not pay claims for physical therapy performed by unlicensed aides unless they are supervised by on-site licensed healthcare professionals such as a doctor or licensed physical therapist.
Additionally, authorities alleged that the RN never had a licensed healthcare professional at the clinic. Instead, the RN contracted with a handful of doctors for patient evaluations and prescriptions. But the physicians were not on-site and did not supervise the sessions or the technicians.
Between 2012 and 2016, the RN allegedly billed for more than $7 million in fraudulent claims, and the Department of Labor paid out more than $6 million of that.
The RN was also convicted of one count of aggravated identity fraud for using the license information of a physical therapist in 2012 to get the Department of Labor to issue a provider number for the program.
The Texas Board of Nursing sent a letter to the RN regarding the issue so then she can have the chance to defend herself. However, she was not able to provide a good defense for herself. Therefore, the Board placed her RN license to a disciplinary action instead.
