Accusations are stressful issues for an RN or LVN, except when a nurse attorney assists you against the case. On or about April 10, 2007, the LVN from Dallas prepared a syringe with ten (10) Units of Lantus Insulin, without a witness and without documenting it, for a patient. and then gave the syringe to the patient’s nephew for transport out of the hospital to the nursing home where the patient had been transferred. Her conduct was likely to injure the patient in that it placed the patient at risk of receiving the incorrect dosage or incorrect medication.
In response to the incident, the LVN states that she was under the impression that the nursing home and the charge nurse had made arrangements for someone from the nursing home to come and pick up the Lantus and that the charge nurse had documented it. The patient had an order for ten (10) Units of Lantus in the hospital. When the person arrived to pick up the Lantus, he identified himself as being from the nursing home and the charge nurse ordered the LVN to get the ten (10) Units of Lantus. The LVN drew up the ten units of Insulin in front of the nephew.
The Texas Board of Nursing then subjected the LVN and her license into disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the LVN hired one.
