Her conduct was likely to defraud the facility and patients of the cost of the medications, and is a violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

On or about June 2, 2014 through July 3, 2014the LVN again withdrew Dilaudid and Fentanyl from the Medication Dispensing System (Pyxis) for patients, but failed to follow the facility’s policy and procedure for wastage of the unused portions of the medications.

As part of the defense, the LVN denied all the accusations against her. She says that she is doing everything she can to do her job well. However, without the help of a good nurse attorney, the LVN failed to defend her case. The result is a suspension and discipline by the Board of Nursing.
