An allegation or complaint could be a serious case, which is why a nurse attorney is needed if you get accused of this kind of scenario. However, some who thought they were guilty of the charges failed to hire a nurse attorney just because they thought it’s the doom for their license already. But that is not entirely the case as there is still hope.
Unfortunately, an LVN from San Antonio failed to do this which resulted in disciplinary action. Take note that the Board of Nursing who handles all of the cases may affect the nurse’s license from receiving the suspension, disciplinary action, or revocation. However, with a right nurse attorney for the case, rest assured that the case can go according to the LVN’s favor, especially if the LVN has a good defense against the case.
On or about October 21, 2013 through November 5, 2013, the LVN misappropriated Morphine, Dilaudid, and Zofran belonging to the hospital and patients thereof, or failed to take precautions to prevent such misappropriation. Her conduct was likely to defraud the facility and patients of the cost of the medications, and is a violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.
On or about June 2, 2014 through July 3, 2014the LVN again withdrew Dilaudid and Fentanyl from the Medication Dispensing System (Pyxis) for patients, but failed to follow the facility’s policy and procedure for wastage of the unused portions of the medications.
As part of the defense, the LVN denied all the accusations against her. She says that she is doing everything she can to do her job well. However, without the help of a good nurse attorney, the LVN failed to defend her case. The result is a suspension and discipline by the Board of Nursing.
If you ever undergo cases such as this, it’s best to seek the assistance of a good nurse attorney as it could make the case better in your favor. Be sure to find a nurse attorney who’s experienced and knowledgeable in several cases to ensure the best assistance possible.
