If an RN or LVN receives a notice of investigation from the Texas Board of Nursing, a legal representation in the person of a nurse attorney in Dallas can help protect their rights and make sure that they are given fair treatment throughout the process.

This is exactly what happened to an RN in Dallas. At the time of the incident, the RN was employed as a Director of Nursing in a hospital in Houston  and had been in that position for one year and eight months.

On or about February 2019, the RN allowed a Licensed Vocational Nurse for whom she was administratively responsible, performed comprehensive nursing assessments for home health recertification, which is beyond the scope of practice for a Licensed Vocational Nurse.

The RN’s conduct was likely to injure the patients from clinical decisions based on assessments performed by a Licensed Vocational Nurses who lacked the education to perform comprehensive assessments.

Subsequently, the RN allowed a Registered Nurse, for whom she was administratively responsible, to document and sign comprehensive assessments for home health recertification, that were actually completed by a Licensed Vocational Nurse. Her conduct created fraudulent medical records

In response to the allegations, the RN states due to a lack of Registered Nurses in the area, there was only herself and one other Registered Nurse to perform comprehensive assessments for home health recertification for twenty patients.

In addition, the RN also states she was being pressured by administration to complete the recertification assessments so that patients and money would not be lost, and the administrator was aware that Licensed Vocational Nurses were performing the assessments instead of Registered Nurses.

Because of the incident, the Texas Board of Nursing disciplined and suspended the RN.
