Some nurses tend to forget the fact that a nurse attorney is what they need when accused of numerous accusations. Because they really felt like they should be responsible even if they never intended to commit such an error. 

At the time of the initial incident, an RN was employed as a Registered Nurse at a hospital in Houston, Texas, and had been in that position for one (1) year and eight (8) months.

On or about August 14, 2020, the RN became non-compliant with the Confidential Agreed Order for Peer Assistance Program issued to her by the Texas Board of Nursing on August 14, 2018. Noncompliance is the result of the RN’s failure to comply with all requirements of the Texas Peer Assistance Program for Nurses (TPAPN) participation agreement, in that the RN failed to check into the program’s drug testing administration system and missed four (4) drug screens. Furthermore, on July 17, 2020, the RN submitted a specimen that was dilute and on July 24, 2020, the RN submitted a specimen that was invalid and determined not possible to be unadulterated human urine. Section I, Stipulation D of the Confidential Agreed Order for Peer Assistance Program dated August 14, 2018, states:

“RESPONDENT SHALL comply with all requirements of the TPAPN participation agreement during its term… “

On or about August 14, 2020, the RN was dismissed from TPAPN and referred back to the Board. As a response to the incident mentioned above, the RN neither admits nor denies the allegation.

As a result, the Texas Board of Nursing (BON) placed her license on disciplinary action. It’s too bad that she failed to hire a nurse attorney in San Antonio for assistance if she had every reason to defend herself in the first place. Her defense would have gotten better if she actually sought legal consultation from a Texas nurse attorney as well.
