Whenever an LVN or RN finds herself in such a situation subjected to a disciplinary proceeding before the Texas BON, she will need to find the best nurse attorney in the country. This is important, as it is her only chance to protect her RN / LVN license. Otherwise, the BON may find her guilty in the administrative case and order for the revocation of her RN / LVN license.
The disciplinary proceeding before the Texas Board of Nurse (BON) is an administrative proceeding wherein LVN / RN are charged for the commission of an offense or violation of certain state laws.
A perfect example of this incident happened to an LVN on or about May 17, 2013. At the time of the initial incident, the LVN was employed in a Medical Center in Dallas, Texas and had been in this position for fourteen months.
On or about May 17, 2013, the LVN misappropriated intravenous fluids and supplies that were used to administer intravenous fluids to herself. The LVN was on duty, she did not have a physician’s order and was not checked in as a patient.
On the same day, the LVN left her assigned patients for more than one hour without notifying a supervisor. She was receiving intravenous fluids while she was on duty. The LVN’s conduct was likely to defraud the facility of the cost of intravenous fluids and supplies. Furthermore, her conduct was likely to injure patients in that leaving her nursing assignment could have resulted in the patients not getting the care that they need.
As a defense to the complaints against her, the LVN admits in part and states that she was scheduled to work but was sick with vomiting and diarrhea. When she arrived to work, the LVN told the Shift Supervisor that she did not feel well and wanted to leave as soon as he would allow her to leave. Her supervisor asked her if she wanted him to start an IV and she replied okay. An IV was started with two liters of NS which took about 15 minutes. She received two bags of IV fluids and another LVN was monitoring her patients. She does not feel that she abandoned her patients as she had given a report to another nurse and he was monitoring her patients, plus she was monitoring them via her computer.
However, the Texas BON found her guilty for her deeds. Thus, her LVN license was suspended.
She failed to justify her case to the Texas BON by not hiring a nurse attorney that will properly defend her.
