In nursing care, a complete and accurate medical record, in a timely manner, brings positive outcomes on the health improvement of a patient. On or about July 3, 2020 through July 25, 2020, while employed as an LVN with an in-home care services provider in Garland, Texas, LVN accepted nursing assignments for patients but failed to submit documentation including pending corrections, patient discharges, re-certifications, and orders for twelve (12) different patients. LVN’s conduct resulted in inaccurate medical records and was likely to injure the patients, in that subsequent care givers would rely on her documentation for further care.
In response to the incident, LVN states she was genuinely worried for her safety and could no longer visit her patients. She states she did make the visits, however, failed to submit the documentation for those visits. She states she was afraid and alone and the agency would not accommodate her request to be assigned to a Hospital. RLV states she decided to leave her position with the agency without notice.
The above actions constitute grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B),(1)(D)&(3) and 22 TEX. ADMIN. CODE §217.12 (1)(A),(1)(B),(1)(C)&(4).
However, without enough evidence to prove she’s not guilty, the LVN lost the case. This is the reason why the Texas Board of Nursing placed her LVN license under disciplinary action.
